SKILLFUL REFUND POLICY

By accessing and/or viewing and/or using the Website and/or the Platform, and/or giving your consent by clicking the respective “I agree” button (or as another similar wording may be available) when You access, use, register or purchase at the Website and/or the Platform through any mobile phone, tablet, computer, or another device, you as a user (“You”, or “User”) of the Website and/or the Platform, confirm that You have read, understand and agree to be bound by this Refund Policy, and applicable law.

SKFL SOLUTIONS LIMITED, a company registered in the British Virgin Islands, with legal address: Intershore Chambers, Road Town, Tortola, British Virgin Islands (“SKILLFUL AI”, or “We”, or “Us”), may change this Refund Policy at any time without notice, effective upon their posting to the website(s) www.app.skillfulai.io and www.skillfulai.io (while www.skillfulai.io refers as the “Website”, and www.app.skillfulai.io as the “Platform”), including all its subdomains. Continued use of the Website and/or the Platform will be deemed Your acceptance of the revised Refund Policy.

If You disagree with this Refund Policy, please do not use the Website or the Platform.

THIS REFUND POLICY APPLIES ONLY IF YOUR ACCESS TO SKILLFUL AI’S SERVICES HAS BEEN PURCHASED DIRECTLY ON THE WEBSITE/PLATFORM AS AVAILABLE VIA THE WEBSITE/PLATFORM. ANY FEATURES OF THE PLATFORM (SUBSCRIPTIONS, ADD-ON ITEMS, OTHER OFFERED) PURCHASED VIA A THIRD-PARTY APPLICATION STORE ARE SUBJECT TO SUCH APPLICATION STORE'S REFUND POLICIES; THUS, YOU HAVE TO REFER TO THEM TO SEEK A REFUND.

1. ENTIRE AGREEMENT

1.1. This Refund Policy must be read together with Our Terms and Conditions and Privacy Policy, as they collectively constitute the entire Agreement between You and Us.

1.2. All definitions of capitalized terms used herein for which no definitions are provided shall have the same meaning as defined in Our Terms and Conditions.

2. SUBSCRIPTION PURCHASE AND POSSIBILITY OF CANCELLATION

2.1. Through the Website and/or Platform, You may purchase the subscriptions and certain add-ons using the payment options available, and by entering Your payment-related information and/or connecting Your payment card/account/wallet, or otherwise as required and available (the “Purchase”).

2.2. You agree that the Purchase is final, that We will not refund any transaction once it has been made, and that the Purchase cannot be canceled unless the refund/cancellation provisions are specified in this Refund Policy and applicable to Your case.

3. REFUND ELIGIBILITY

3.1. Unless expressly set forth herein, any fees paid are non-cancelable and non-refundable.

3.2. Subscription cancellation. You may cancel Your subscription plan by opting out of Your subscription plan's auto-renewal before the expiration of the relevant current term (subject to the Terms and Conditions as available on the Website and/or the Platform). If all the instructions are followed and You successfully opt out of auto-renewal, You will not be charged for the next relevant term of the subscription plan. However, We will not refund any fees paid for the current subscription plan.

3.3. Add-ons cancellation. If You made the Purchase of any additional features (such as add-ons or similar one-time purchased content/functions), other than the subscription plan, please be advised that We will not refund any related fees paid if You

3.4. We also reserve the right not to refund You any fees paid in case You are or may be in violation of Terms and Conditions, or any law, or regulation, and disclaim any obligation and liability in relation to such refund.

3.5. We are not liable for any refund due to defect/dysfunction on Your device or otherwise on Your side and as not controlled by Us (as well as other cases as may be stated in Our Terms and Conditions), including but not limited to inability to install and/or problems due to Internet connectivity.

3.6. We reserve the right not to refund You fees paid with crypto-assets, except in cases subject to the following clause.

3.7. However, We reserve the right, at Our sole discretion, to refund amounts paid, under certain circumstances as We deem appropriate, on a case-by-case basis. In a way of example, but not the obligation or warranty: We may, at Our sole discretion, refund You a subscription plan fee that was paid as a double transaction due to a technical error. In such a case, You have to contact Our customer service within 14 (fourteen) calendar days of the Purchase with the error in question.

3.8. In relation to the Purchase in question, You may be entitled to one refund only. After Your refund approval, any further or other Purchases will be subject to other refund requests (should you wish to request any).

3.9. Refunds cannot be made due to price changes, promotional pricing, discounts, or any other promotional offers made after the Purchase.

3.10. Purchases via third-party application store. Please note that Purchases made through the Application Store (App Store or Play Market) are final, and We will not provide a refund for them. Such Purchases will be subject to refund in accordance with the terms of the applicable third-party policy, which also may not provide for refunds.

4. REFUND PROCESS

4.1. To request a refund, please contact Our customer service at support@skillfulai.io. We will make reasonable efforts to consider Your refund request within 14 (fourteen) calendar days of receiving it.

4.2. Refund requests are considered individually. To make a decision about Your refund request, We may ask You to provide the following information (including, but not limited to):

  • 4.2.1. Your device’s model, operating system, and version;
  • 4.2.2. the steps You are taking when this issue appears (if the reason for the refund request is malfunctions);
  • 4.2.3. a screen video or screenshots that would illustrate the issue (if the reason for the refund request is malfunctions);
  • 4.2.4. any additional information that would help Us identify the problem if the details You have already provided are insufficient to identify the issue you're experiencing.

4.3. If We approve Your refund request, the amount will be refunded to Your account by the same method used for the initial payment unless otherwise mutually agreed upon. Please note that to process the refund payment, We use the payment processors. Such services enable the transaction initiated by You and notify Us of its completion. We may not make the refund payment directly to You, but inform the payment processors of what We have agreed upon, and the payment processors will issue the relevant refund. Please note that the payment processors reserve the right to issue refunds at their discretion, according to their own terms and conditions, and other policies of such third-party services.

4.4. We will make reasonable efforts to ensure that all refunds approved will be made according to the Purchase price paid at the time of that Purchase.

4.5. If Your refund request is approved, We reserve the right to charge a fee to cover the cost of any bank, administrative or other expenses We may suffer or have suffered due to such refund or Your Purchase, to the extent permitted by applicable law.

4.6. If You are a resident of the European Union, You have certain rights to withdraw from distance purchases; however, please note that when You order the Purchase, You acknowledge and agree that You accept and consume the Purchase promptly once Our servers/systems (or We, in other methods) validate Your Purchase, therefore Your right of withdrawal is lost at this point.

4.7. BY STARTING THE PURCHASE, YOU HEREBY EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THIS AGREEMENT AND ACKNOWLEDGE THAT YOU WILL LOSE YOUR RIGHT OF WITHDRAWAL FROM THE AGREEMENT ONCE OUR SERVERS/SYSTEMS (OR WE, IN OTHER METHODS) VALIDATE YOUR PURCHASE, EXCEPT FOR THE CASES DESCRIBED IN THIS AGREEMENT.
